Dec. 29, 2010 - State loses court ruling on greenhouse gases

A federal appeals court on Wednesday rebuffed an effort by Texas officials to fight a federal plan to regulate carbon dioxide and other greenhouse gases.

The U.S. Court of Appeals for the Fifth Circuit denied the state's request to prevent plans by the Environmental Protection Agency to issue greenhouse gas permits after the Texas Commission on Environmental Quality refused to do so. The U.S. Court of Appeals, D.C. Circuit, had already denied similar arguments by the state.

Texas is the only state that has refused to implement the permitting rules for refineries and power plants that go into effect after the start of the year.

State officials have said the EPA's decision to take over that portion of the state's air permitting program would destroy jobs.
